A deferred prosecution agreement hearing has been scheduled for a Brownsville man accused of shooting a cat in the eye.

Patrick Dalle-Nogare, 17, appeared Monday in Dodge County Circuit Court where he is charged with mistreatment of animals. The charge carries a maximum penalty of a $10,000 fine and nine months in jail.

A Theresa woman told police she believed Dalle-Nogare was responsible for shooting her 4-month-old cat in the eye with an arrow on the 24th of September, 2007. She told officers she was very "shocked, sick and upset" that someone would do this to an animal. She also told officers if they didn't bring charges against the person responsible, she would contact PETA and have them look into the matter, according to the criminal complaint.

During the investigation, Dalle-Nogare told officers he was hunting on the woman's property when he saw the cat near a barn. The Brownsville teen said he aimed at the cat, but didn't think he would hit it and fired, according to the complaint.

The woman told officers they were able to remove the arrow from the cat's eye and did not have to take the animal to a veterinarian, according to the complaint.

Dalle-Nogare, who is free on a $500 signature bond, is expected to make his next appearance on the 28th of May for a possible deferred prosecution agreement.

Moggies comment: Deferred Prosecution Agreement? The accused is guilty, why is there a need for an unneeded agreement? What is it with some judges and courts, are they really that stupid they do not understand a guilty case? Patrick Dalle-Nogare should have the book thrown at him, a large fine and imprisonment is the only way to go. What is the point of having a maximum fine and imprisonment if they are not used in such cases, it really does make a mockery of the law and is an insult to all outside the legal system.
